Terms of Service

1. Agreement to These Terms

OmniCoach ("we," "us," or "our") is operated by Dichotomy.ai. These Terms of Service ("Terms") govern your use of the OmniCoach mobile application, the website at dichotomy.ai, and related services (collectively, the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 18 years old to use the Service. By using the Service you represent that you meet this requirement and that you have the legal capacity to enter into these Terms.

3. Not Medical Advice

OmniCoach provides training plans, readiness scores, and coaching suggestions generated from your activity, sleep, stress, and recovery data. This content is for general fitness and informational purposes only. It is not medical advice, diagnosis, or treatment, and it does not replace the judgment of a physician or licensed healthcare provider.

  • Consult a physician before starting or changing any exercise program, especially if you have a medical condition, injury, or are pregnant.
  • Stop exercising and seek medical attention if you feel pain, dizziness, shortness of breath, or other symptoms.
  • You are solely responsible for deciding whether, when, and how hard to train. Endurance sport carries inherent risk of injury, and you assume that risk.

4. Your Account

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Provide accurate information and keep it current. Notify us promptly at martin@dichotomy.ai if you suspect unauthorized use. You may delete your account at any time from the app's settings.

5. Connected Services and Health Data

The Service works with third-party platforms such as Garmin Connect and Apple Health. Your use of those platforms is governed by their own terms. You authorize us to receive and process the data you choose to connect, as described in our Privacy Policy. We are not responsible for the accuracy, availability, or behavior of third-party devices or services, and coaching output is only as good as the data those services provide.

6. Subscriptions and Payment

Some features require a paid subscription. Subscriptions purchased in the iOS app are billed through Apple's App Store and are subject to Apple's terms. Prices are shown at the point of purchase.

  • Subscriptions renew automatically at the end of each billing period unless cancelled at least 24 hours before renewal.
  • Manage or cancel your subscription in your App Store account settings. Deleting the app does not cancel a subscription.
  • Refunds for App Store purchases are handled by Apple under Apple's refund policy.
  • Free trials convert to a paid subscription unless cancelled before the trial ends.

7. Coaches and the Coach Marketplace

The Service may let you connect with human coaches. Coaches are independent third parties, not employees or agents of Dichotomy.ai. We do not verify coaching credentials beyond what a coach chooses to display, and we are not a party to any agreement between you and a coach. Any advice a coach provides is theirs, not ours.

8. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose.
  • Access the Service by any automated means, or scrape, probe, or reverse-engineer it, except as permitted by law.
  • Upload content that is false, infringing, harassing, or harmful.
  • Interfere with the Service, other users, or our infrastructure, or attempt to bypass usage limits or security measures.
  • Share your account or resell access to the Service.

9. Your Content

You retain ownership of the data and content you provide. You grant us a worldwide, non-exclusive, royalty-free license to store, process, and display that content solely to operate and improve the Service, including generating your training plans and coaching insights. We do not sell your personal data.

10. Our Intellectual Property

The Service, including its software, models, design, text, graphics, and the OmniCoach and Dichotomy.ai names and logos, is owned by Dichotomy.ai or its licensors and protected by intellectual property laws. We grant you a limited, revocable, non-transferable license to use the Service for personal, non-commercial purposes in accordance with these Terms. No other rights are granted.

11. Beta Features and Availability

Parts of the Service may be offered as beta or preview features. They may change, break, or be withdrawn without notice. We do not guarantee that the Service will be uninterrupted, error-free, or available at any particular time.

12. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms, if required by law, or if we discontinue the Service. On termination, your license to use the Service ends. Sections that by their nature should survive (including 3, 9, 10, 13, 14, 15, and 16) will survive.

13. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT ANY TRAINING PLAN OR RECOMMENDATION WILL ACHIEVE A PARTICULAR RESULT OR IS SAFE FOR YOU.

14. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, DICHOTOMY.AI AND ITS OFFICERS, EMPLOYEES, CONTRACTORS, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY PERSONAL INJURY, LOSS OF DATA, OR LOSS OF PROFITS, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE, OR ONE HUNDRED US DOLLARS, WHICHEVER IS GREATER. SOME JURISDICTIONS DO NOT ALLOW THESE LIMITATIONS, SO THEY MAY NOT APPLY TO YOU.

15. Indemnification

You agree to indemnify and hold harmless Dichotomy.ai from any claims, damages, and expenses (including reasonable legal fees) arising from your use of the Service, your content, or your violation of these Terms.

16. Governing Law and Disputes

These Terms are governed by the laws of the State of Washington, USA, without regard to conflict-of-law rules. Any dispute will be brought in the state or federal courts located in King County, Washington, and you consent to their jurisdiction. Before filing a claim, you agree to contact us and attempt to resolve the dispute informally for at least 30 days.

17. Changes to These Terms

We may update these Terms from time to time. We will post the updated Terms on this page and update the effective date, and for material changes we will notify you in the app or by email. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
